Intellectual Property Claim

If you believe that African Pride has infringed your intellectual property rights, you can file a complaint using our email address support@afroprintwear.com. Below is the procedure for reporting intellectual property infringement.

A. How to Report Intellectual Property Infringement

Our policy includes:

  1. Blocking or removing any content (text, graphics, photos) that we believe in good faith infringes on third-party intellectual property rights upon receiving a valid notice.
  2. Terminating services to repeat infringers.

If you believe content on our website violates your intellectual property rights, please send a notice with the following information to our Designated Agent, or submit it via our email support@afroprintwear.com:

  1. Identification of the copyrighted work or intellectual property being infringed, including registration numbers if applicable.
  2. Identification and description of the infringing content, including its location on our website.
  3. Your contact information (full name, address, phone number, email).
  4. A statement that you have a good faith belief the disputed use is unauthorized.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and you are the rights holder or authorized to act on their behalf.
  6. An electronic or physical signature of the rights holder or authorized agent.

B. Actions Taken Upon Receiving a Valid Notice

Upon receiving a valid notice, we may:

  1. Remove or disable access to the infringing material.
  2. Notify the content provider of the removal or disablement.
  3. Terminate the content provider’s access to our services if they are a repeat offender.

C. Counter-Notice Procedure

If we believe that the removed content is not infringing or that we have the right to use it, we may submit a counter-notice to the Designated Agent with the following information:

  1. Identification of the content that was removed and its location before removal.
  2. A statement under penalty of perjury that the content was removed due to a mistake or misidentification.
  3. Our contact information (full name, address, phone number, email).
  4. A statement consenting to the jurisdiction of the Federal Court for our district.
  5. An electronic or physical signature.

If a counter-notice is received, we may notify the original complainant and replace the removed content or restore access within 10-14 business days, unless the rights owner seeks a court order to prevent this.

Please note: Under Section 512(f) of the DMCA, any person who knowingly submits a false claim may be liable for damages, including attorney's fees.
